Claims rules

1/ Claim of evident goods defects

The buyer is obliged to examine the delivery to make sure it is intact before its processing. In case of evident goods defects, at least 90% of goods must be available for examination of the evident defect and the buyer is obliged to enable the seller and the technical department to inspect the goods in storage and during  processing  of the defective goods. The deadline for claiming evident goods defects is maximum 7 days after goods delivery.

2/ Goods amount claims

The buyer is obliged to claim the delivered goods amount no later than 3 days after the date of goods delivery. The diffefence between the delivered amount and declared amount must be properly marked on the supplier's delivery note and CMR. The permissable error for sheet paper delivery is 1% (for original pallet delivery the permissible error is 4%). The paper delivery is considered to be fulfilled, when the delivered amount in tons was:

3/ Quality of goods claims

The buyer is obliged to submit a claim in writing to the seller SCP PAPIER, Inc. Unsorted marked printed and unprinted sheets, labels from rolls or pallets, which are are the subject of the claim, as well as photodocumentation, should be enclosed with the claim. It is also neccessary to calculate the expenses incured due to the damage in monetary units and state the required compensation (in case the damage is higher than the price of claimed goods, it is neccessary to prove and document all expenses). In case the buyer claims other damaged material (boards, offset covers or other damaged goods or parts), it is neccessary to document the damage – photodocumentation, submitting the damaged part, the receipt proving the purchase price of the damaged part (material).

4/ Processing claimed goods

The processing of claimed paper is only possible with the seller’s agreement. In case the damage was not claimed in time and a part of the delivery was processed, it is necessary to have at least 50% of claimed goods not processed and available for clear identification. If the claim is delayed or the buyer processes claimed goods without written permission, all buyer’s rights will expire.

5/ Claims procedure

The supplier is obliged to answer claims in writing in compliance with the Commercial Code. The seller reserves the right to accept or reject the claim based on the producer’s professional  examination. The supplier is obliged to complete the claim procedure no later than 60 days from the initiation of the claim.

Inspection of delivered goods

When accepting goods, the following principles must be adhered to:

1/ Inspect the real condition (amounts) and declared condition of the goods, if possible prior to unloading. If there is evident goods damage or the goods were unsuitably placed on the vehicle, it is necessary to create photodocumentation prior to unloading.
2/ During unloading it is important to check the condition of any packaging, the appearance of goods, confirm the weight stated on the delivery note (including the number of sheets on a pallet), look out for evident damage, incorrect storage in transportation packaging (pallette) as well as damage to the packaging material itself, which could result in mechanical damage to the goods.
3/ All findings need to be noted in the delivery documents (including CMR – international vehicles, the driver’s signature) and a written record needs to be produced together with the driver.
4/ Deliveries of paper sheets need to be inspected for their tracing and count as well as the arrangement of paper stacked on pallets.

In case any of the above-mentioned shortcomings are discovered, the buyer needs to inform the sales department and the sales representative by phone and all necessary documentation should then be sent to innitiate the claims procedure. If the buyer fails to adhere to the above-mentioned principles and does not initiate the claims procedure in time, the buyer's rights to a claim will expire.
